No, they can only build KINGDOM fortifications on their OWN island. If a Pirate wants to put a wall in front of your house on the pirate island they're entitled, that's the risk you take in putting a house on a kingdom island while not being a kingdom member. And if it was a rogue pirate, you have to have a good pirate chop it down - that doesn't seem unreasonable considering you technically have no business being on their island in the first place.
