i need someone to make me a head that looks like seifer's head off Final Fantasy 8.

Maybe if he would have made the head and had not said anything of FF8, it would have been fine. People would have taken it as a regular head. Now that someone has asked for it...and someone sees it...they will be like 'y0, that's from FF8!'

i dont think they would be able to sue graal for that.
because it wont be the same and it wont be called headseifer.gif
it would be called something like head3000.gif or something.

Correct, that would break copyright law. It doesn't matter if it has the same name or anything (having the same name is pointless and would be something stupid to sue over). If it looks like it, it breaks copyright law though, or has any likeness about it.

arrrrg i still cant find the god damn head.
i have looked through all the 800s (are you sure its there) but a hell of alot of those heads are missing!
