If you make something based on some copyrighted thing, and claim it as your own then that is illegal.. no?

People have to pay to use it if the head is on a P2P server..

If he wouldn't have mentioned "Sponge Bob," it would have been fine. It wasn't ripped from any copywritten image, or atleast I don't think, so you can call it a plain 'ole sponge head.

Valid point, but Kid Rock, and Fred Durst are not copyrighted, you cannot copyright the human form (I looked it up). Spongebob though, is not human

That doesnt bust him. He might have made it,
and unholy nation uploaded it. If you read his post it says "my infamous spongebob head" which implies that he has made it before and some have known it for quite some time.
