If you make something based on some copyrighted thing, and claim it as your own then that is illegal.. no?

If he wouldn't have mentioned "Sponge Bob," it would have been fine. It wasn't ripped from any copywritten image, or atleast I don't think, so you can call it a plain 'ole sponge head.

Valid point, but Kid Rock, and Fred Durst are not copyrighted, you cannot copyright the human form (I looked it up). Spongebob though, is not human
