The precedent has been that folks (folks being either the thread creator or a moderator) can request that a thread be held on-topic from the onset. In that event, off-topic posts can be dealt with accordingly. However, this has not occured here. If you make a thread and it doesn't go the way you want it to, you're not allowed to go back and say "Hey, wait, you can't go this way." (unless, of course, you are a nifty supermod and can do that - not to say that it should be done without some compelling reason, though). It already has gone.

It depends. If the topic of the thread is shifting, then the off-topic post is by definition off of the original topic, but it is by assumption still relevant to the thread and thus not spam. That make sense?
