Kind of an inapplicable analogy. DX9 is designed for the same platform as DX8 - there aren't going to be any compatibility issues there.
I too hear that DX9 doesn't work well with some games. My only guess would be that they implemented something differently, or used some bad code. It's not really a matter of compatibility.
