Just to clarify
 
Scamming is legal as long as you don't abuse any bugs or glitches right?
Does it matter if you have a long ban history though?

What if the staff never witnessed it and only had the proof of whatever the player told him and still followed it out because he had a grudge agaisnt that player that got banned?

Well, as it says - if the the user is ruining the fun for other players it may not be a "grudge" but a "last straw".

He doesn't use the forum, and yeah I already sent in a ticket but he rejected it like it was nothing.

Although, if someone is silly enough to give someone else their items to "test" I believe it's their own fault and there should be no punishment
